TERMS AND CONDITIONS


 

CHANGING TERMS OF USE
IVA holds the right to change the terms of use at any moment without previous notice. Changes take effect at the moment of denunciation. Visitors are obligated to notice those changes and adapt to them.
PRICES AND DURATION OF THE ARRANGMENT
Prices for all arrangements are given per person based on services mentioned in the program. Every additional request regarding the accommodation requires additional payment and must be outlined in the Travel Application. I Visit Albania reserves the right to change the prices of the arrangement, in case of changes of the currency parities or transport price changes, until the whole amount of the arrangement has been paid.

Any prices quoted on this site are subject to change without notification. All prices are quoted on a 'from' basis and are subject to availability.
The price includes all the services mentioned in the program. All additional expenses: phone calls, room service, snacks, drinks, etc. are covered by the traveler.

RESERVATIONS
Inquires and accommodation reservations can be made via e-mail, in writing or in person at any of the Agency's branch offices as well as at the offices of our partner travel agencies. By confirming a reservation, the Traveller confirms that he/she is aware of the General Terms and conditions of the travel services and fully comprehends and accepts these terms which are binding for both the Traveller and the Agency.

The Agency provides the Traveller with the appropriate materials in electronic form, presenting all relevant information regarding the trip, and provides or points out the general terms and conditions of the trip which are an integral part of this Agreement, as well as offers a travel insurance package. The Traveller is obligated to provide any information required for the reservation process. A deposit is required depending on the chosen payment method. The balance payment is due at least 30 days before arrival unless otherwise specified upon booking confirmation.

The service provider reserves the right to withhold service to the Traveller if the Traveller brings a pet to the accommodation without previously notifiying the Agency or the service provider. In this case, the Agency is not obligated to accept complaints made by the Traveller on the quality of the booked accommodation or services.
Promotions and discounts cannot be aggregated with each other or combined. Each reservation can contain only one discount.

PAYMENT FOR YOUR TOUR

There is not extra fee for online payments at one of our websites. The price you see is the price you pay. The Client acknowledge that I Visit Albania pre-negotiates certain rates with suppliers to facilitate the booking on his behalf. The Client authorizes I Visit Albania to make reservations for the total reservation price, which includes the rate displayed on the Website.

The Client agrees that his/her credit/debit card will be charged by Moneybooker Ltd on behalf of I Visit Albania. The amount charged will be the equivalent of the total reservation price in euro. More detailed information regarding payment terms is given when you are transferred to the Moneybooker’s website for payment processing. In some specific cases to be determined by I Visit Albania, the Client will be required to prepay or guarantee the booking in an alternative manner. If the Client is unable or unwilling to do this, we reserve the right to refuse the reservation service.


Note for payments made from abroad - This method of payment refers exclusively to foreign clients. It is necessary to transfer the value of the reservation to the foreign account of the agency. The payers and recipients bank transfer fees are covered entirely by the client.

According to your inquiries for booking we will send you our offer by e-mail. With our confirmation you will get the total cost of your holiday. Reservation is possible only by paying the pre-reservation amount (deposit), 10-20% of the total amount, or the entire amount to our agency before arrival. After we receive the deposit or the entire amount we will send you the confirmation of reservation and details of the arrangement (details of the host, guests details, date of arrival and departure and also other services that guest has paid)

CANCELLATION POLICY, CLAIMS & REFUNDS 
The Client may cancel or change the prepaid reservation or other service, but this may result in cancellation or reservation change fees, set by the service provider. Furthermore, if the Client does not show up, cancel or change his/her reservation before the cancellation terms set by the hotel or service provider, he will be subject to a charge of applicable nightly rates for hotels and set charges for other services. In these cases the rest of the reservation will be cancelled automatically and if the penalty applicable is less than the total amount paid by the client, the remaining difference will be refunded by IVA.

The above cancellation policy will also apply to early interruption of reserved services. For exceptions to this rule we must have a written notice in the form of a letter, e-mail or SMS message from the service provider, confirming acceptance of the interruption of services from the client without penalty.
It is the Client’s responsibility to check and accept the cancellation policy of the hotel or service provider he books as published on the Websites.
Any financial claims and compensations will be strictly based on this policy.

For tours, meetings or other services provided by IVA except online hotel and car rental reservations, the following cancellation policy will apply:
a. If the reservation is cancelled/amended 30 days or more, prior to the arrival date, then a full refund will be given, minus a 5% fee for credit card transaction charges. If refunded by bank transfer the client will be liable for bank transfer charges.

b. If the reservation is cancelled/amended 30 to 21 days, prior to the arrival date, a 30 % penalty of the total amount paid will apply.
c. If the reservation is cancelled/amended 21 to 7 days, prior to the arrival date, a 50 % penalty of the total amount paid will apply
d. If the reservation is cancelled/amended less then 7 days prior to the arrival date a non-refund will apply.
e. In case of no shows or early interruption of services a strict non-refund rule will apply

CANCELLATION AND CHANGES
Complete withdrawal from the travel is considered as a cancellation, and any kind of changes concerning a iVA-Travel application are considered as a change (travel date, accommodation, change of clients…). In this case, client needs to agree in written form before the arrangement starts, or continue with the travel and make a payment with clearly specified deadline.
The duration of the arrangement is marked with calendar days marked in program, depending on the first and last service from the program. Its duration doesn’t have to be 24 hours.

If the client withdraws from the arrangement due to a circumstance which was not his fault (death, accident, unexpected deterioration of health…) I Visit Albania is NOT obligated to return paid amount, with reduction of handling costs to a client.

In this case client is obliged to deliver to I Visit Albania written confirmation about the cause of cancellation from authorities within the 5 days.
In any other case I Visit Albania has the right on the compensation due to cancellation or changes according to mentioned deadlines, and percentages related to total amount of the arrangement:

ACCORDING TO DEPARTURE DAY
60 and more days before tour start date
42-59 days before tour start date
28-41 days before tour start date
14-27 days before tour start date
Less than 14 days before tour start date

From these compensations the prog. I Visit Albania with specially mentioned conditions of cancellation are excluded.
In situation that I Visit Albania cancels the arrangement, the whole amount without the interest, will be returned to a client.
IVA reserves the right to cancel any trip prior to departure for various reasons: in the very unlikely event IVA should cancel a trip (Force Marjory, wars, strike, etc.) IVA is not responsible for any additional expenses incurred by the travelers preparing for their trips.

HOTELS
For cancellation of hotels the cancellation charges are as follows:
· a. for a reservation cancelled up to 30 days prior to the beginning date of the service 15% of the total amount of the reservation or a minimum of 15 Euro
· b. for a reservation cancelled from 29 to 22 days prior to the beginning date of the service 30% of the total amount of the reservation will be charged
· c. for a reservation cancelled from 21 to 15 days prior to the beginning date of the service 50% of the total amount of the reservation will be charged
· d. for a reservation cancelled from 14 to 8 days prior to the beginning date of the service 80% of the total amount of the reservation will be charged
· e. for a reservation cancelled from 7 to 0 days prior to the beginning date of the service 100% of the total amount of the reservation will be charged
· f. if the Traveller does not arrive to the destination or cancels the service of the accommodation after it began, 100% of the total amount of the reservation will be charged
TRANSFERS
In case of cancellation of a confirmed reservation transfer, the following fees are charged:
· a. for a reservation canceled up to 72 hours prior to the beginning date of the service, the administrative costs in the amount of 15 EUR will be charged
· b. if the Traveler does not arrive to the transfer destination or cancels the service within 72 hours before it begins, 100% of the total amount of the reservation will be charged
RECLAMATIONS
Client is obliged to present an eventual objection on the spot, during the travel and to make written notes about it with the representative from I VISIT ALBANIA, that is, with an authorized person of the service provider

Client is obliged to deliver his written objection, together with a proceedings made with a I VISIT ALBANIA representative, within 8 days since the last day of the program. I Visit Albania is not obliged to consider any reclamation, which do not satisfy this conditions.

SERVICE DESCRIPTION
The accommodation units are described by the official categorization of the local tourist organization. Owner is obliged to put the given categorization table on a visible place.
Service standards of the accommodation, food and other are not comparable. Every guest should arrive into a clean and tidy accommodation unit with clean bed linen. For guests who stay longer than one week will get bed linen changed and towels for use.

Guests arrive to accommodation unit after 12.00 h and on the departure day guests leave the accommodation unit before 09.00 h. Guests receive the keys of the unit from the owner itself or agency representative.

9-1. Service description
IVA is the owner and operator of the www.go-albania.com website. IVA is a registered Albanian travel company, which offers a vast range of tourism and related services. Through our above named websites we act as an intermediate between providers of travel, tours and accommodation services and users in order to provide our visitors with the possibility to search and these services online. Our service is based on information provided by our partners. We do our utmost best to ensure that all information provided on this website is accurate. From now on the term “IVA”, “Websites” and “we” will be used to collectively identify IVA (Ltd), www.iva.com while the phrases “Guest” or “Client” or “Visitor”will collectively refer to entities making use of these websites to complete a service reservation.

OFFERS
The Agency ensures services according to the information published and valid at the time of the reservation confirmation, and according to the description and travel period in accordance with confirmed reservations except in circumstances beyond our control such as illness of the service provider or his/her immediate family, outstanding circumstances which cannot be foreseen nor eliminated (natural disasters such as earthquakes, floods, sanitary disruptions, fires, droughts, wars, strike, terrorist actions and limitations issued by the government mobilisation, country exit ban).
RATES
he price of the service includes the basic service as described in the price list for the reserved accommodation unit. Special or extra services are those services which are not included in the base price of the accommodation (marked "on request" in the description of the accommodation unit or Price List/Rates or additional services that are available through prior notification and additional payment) and as such are to be paid by the Traveller along with the reservation amount or at the spot, as indicated in our offer. Special and extra services/requests must be requested or announced during the reservation process.

The average cost of electricity, water and gas is included in the price of the accommodation as are all the sheets and bedding items, final cleaning and other added services which are noted in the description of each accommodation unit. The Traveller is obligated to leave the premises clean and tidy before departure, regardless of the final cleaning charge set by the proprietor. Final cleaning includes washing and stacking of dishes, trash removal and sweeping all the rooms in the accommodation unit so that the accommodation unit is left neat and tidy. You should also bring the toilet paper (apart from when you’re staying at a hotel).

The service rates are stated in Euros. The Agency reserves the right to change the published rates. Travellers who have paid the deposit for a certain reservation are guaranteed by the Agency the accommodation rate listed on the calculation based on which the deposit payment was made. Should rate changes occur prior to the deposit being paid, the Agency is obligated to inform the Traveller of these changes. All involved parties accept that the Agency reserves the right of changing the rates no later than 20 days prior to the beginning of the service if the following occurred after the reservation confirmation: changes in the foreign exchange rate, Should the price of the paid reservation amount increase for more than 10 %, the Traveller has the right to cancel his/her reservation and is also entitled to a refund without any additional compensation.

The rates listed in our offers and programs are formed according to agreement made with our contractors and do not necessarily match the rates stated on the spot at the accommodation unit in which the Traveller resides. Possible differences in rates cannot be subject to complaint.Should the number of people arriving to the reserved accommodation unit exceed the number indicated on the travel documents (voucher), the service provider has the right to withhold service to unannounced Travellers or accommodate all Travellers provided that additional payment for the unannounced Travellers is made on the spot. In this case, the agency does not acknowledge any complaints for quality or services provided at the booked accommodation.

HOTEL INFORMATION, RATINF & CLIENT COMPLAINTS
The Hotel is responsible for ensuring that the Hotel Information (i.e. description, photos etc) included on the website, is correct and up-to-date at all times. Finding ourselves only with a handful of officially rated hotels we have been forced to include also non rated hotels in our Websites.

Rating has been decided by the owners or management of these hotels in consultation with us. We have inspected each of the hotels physically and the findings have been made known to the hoteliers to influence them in giving their properties as objective rating as possible. However Online rating should only be considered a guideline to help you, in making a more informed choice. As a double measure we have also included guest ratings to encourage travellers to help each other and also be as unbiased as possible about hotel ratings. IVA shall not be held responsible in respect of any claim made by any third party relating to any erroneous Hotel Information and/or descriptions and/or photos or any other claims related to services provided by the hotel including possible discrepancies between the actual rating of a hotel and the online rating. Nor do we accept any responsibility for the guest rating section and the comments which appear there

CURRENCY & EXCHANGE RATES
Prices displayed in the Websites include all local applicable taxes and are in Euro. However through our partners Moneybookers Ltd we offer the possibility to pay in several other currencies of your choice. The exchange rate of the Euro in your preferred currency is determined by Moneybookers Ltd
PERSONAL INFORMATION SECURITY
The Traveller provides personal information of his/her own free will. Personal information is required for processing requested services. The same information shall be used for inter-communication. The Agency is under obligation that the personal information of the Traveller will not be taken out of the country or given to a third party except for the purpose of carrying out requested services. The personal information will be kept in a database in accordance with the Management's decision on the method used for collecting, processing and securing personal information. With the acceptance of these General Terms, the Traveller gives permission for his/her personal information to be used for promotional offers of the Agency.
DATA PROTECTION AND PRIVACY STATEMENT
Your privacy is important to us. We will only use the information that we collect about you lawfully, in accordance with the Data Protection Act 1998 and Electronic Communications (EC Directive) Regulations 2003 ("data protection laws"). You confirm that you will only enter information about yourself and those in your party and that such information is true.

For the purposes of the Data Protection Act 1998, we, IVA are a data controller. In order to process your booking, brochure and Tour Note requests, provide your tour and to help us provide you with a more personal service, we need to collect certain personal details from you. These details will include, where applicable, the names and contact details of party members, credit/ debit card or other payment details and special requirements such as those relating to any disability or medical condition which may affect the chosen tour arrangements and any dietary restrictions which may disclose your religious beliefs. If we need any other personal details, we will tell you before we obtain them from you.

We need to pass on your personal details to the companies and organisations who need to know them so that your tour can be provided (for example your airline, hotel, other supplier, credit/debit card company or bank). Such companies and organisations may be outside the European Union, Norway, Iceland or Liechtenstein if your tour is to take place or involves suppliers outside these countries.

We and other companies would also like to store and use your personal details for future marketing purposes (for example, sending you a brochure or details of new features, tours or special offers which we think may be of interest to you, including by email). All details you give us in connection with your booking (including those relating to any disability or medical condition or your religious beliefs) will be kept by us but we and our Group Companies will use only names and contact details for marketing purposes (unless you have indicated that you do not wish us to do so. We respect our customers' privacy and do not sell, rent, trade or give away any of your personal information for any purpose.

We may also send you promotional information about selected third parties' products and services that may be of interest to you. When this happens, we remain in control of your data and it will not be shared outside.

Occasionally we hire other companies to provide services on our behalf, for example mailing information to our customers. We only provide those companies with the personal details relating to our clients which they require in order to deliver the service. They are prohibited from using that information for any other purpose. We will ensure that anyone to whom we pass your details for this reason agrees to treat it with the same level of protection we are obliged to provide.
If you do not want us to do any or all of these things, please let us know as soon as possible.

Except where expressly permitted by the Data Protection Act, we will only deal with the personal details you give us as set out above unless you agree otherwise. We have appropriate security measures in place to protect this information.

You are generally entitled to ask us (by letter or e-mail) what details of yours are being held or processed, for what purpose and to whom they may be or have been disclosed. We will charge a fee to respond to such a request. We promise to respond to your request within 40 days of receiving your written request and fee. In certain limited circumstances we are entitled to refuse your request. If you believe that any of your personal details which we are processing are inaccurate or incorrect, please contact us immediately.
Please note telephone calls may be recorded for training and monitoring purposes.

From time-to-time, our staff, customers and suppliers may take photographs and video footage of tours in progress, including pictures of our customers. These pictures may be used in future marketing materials and stored physically and digitally. If you do not wish for you family to be filmed or for you pictures to be taken or used in this manner, please advise your tour leader and/or the photographer at the start of your trip.

As our privacy statement may change due to developments in the law, we would encourage you to re-read our privacy statement at www.ivisitalbania.com/privacy-policy from time to time so that you are aware of any changes in how we gather and use personal information.

REPLACEMENT OF THE TRAVELER WITH ANOTHER PERSON
The traveler may decide for another person to use the arrangement instead of him/her, as long as the person nominated to travel is able to undertake the responsibilities and obligations listed in the conditions of the arrangement.
RESERVATION OR ONLINE SERVICE AGREEMENT
By making a reservation through the Websites a direct contract is created between the service provider, (hotel, car rental etc) and the Client (the “online service agreement”). IVA acts merely as a medium which makes possible the reservation and payment. The Client is bound to accept the provider as a contractual party, and to accept the online reservation in compliance with the Provider Information contained on the Websites at the time the reservation was made
REFUND POLICY
The following refund policy will apply to cancellation of services:
If the Client proves that the cancellation or early check out was made in time and according to the hotels cancellation policy we will refund the whole amount paid.
Full credit card refunds without any penalty will apply to any cancellations made according to  I Visit Albania’ and their supplier cancellation policies, if this cancellation is made within 30 days from the date of payment. If this 30 day limit from date of payment has passed, credit card refunds will incur a 5% penalty on the sum to be refunded due to processing fees.
For all other forms of payment, applicable bank or transaction fees will be charged.
Cancellations made at least 24 hours in advance for services provided directly by I Visit Albania (i.e transfers, excursions, etc.) except those provided by suppliers ( i.e hotels, car rental reservations etc.) will be refunded without any penalty in compliance with points b and c above
INTELLECTUAL PRPOERTY RIGHTS
We own or license all intellectual property rights in our Website and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. You are permitted to print off copies and download extracts from our Website for your own personal use provided that you do not modify copies in any way. You may draw the attention of others to material posted on our Website. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. Any use of extracts from the Website other than in accordance with this clause for any purpose is prohibited.
Our status (and that of any identified contributors) as the authors or content on our Website must always be acknowledged.
If you upload any copyright protected material (including photographs) to our Website, it is your responsibility to obtain the permission of the copyright owner.

LICENSE TO USE WEBSITE
Unless otherwise stated, I Visit Albania and/or its licensors own the intellectual property rights in the website and material on the website. Subject to the license below, all these intellectual property rights are reserved.
You may view, download for caching purposes only, and print pages or other content from the website for your own personal use, subject to the restrictions set out below and elsewhere in these terms and conditions.
You must not:

REGISTRATION
When you register with us we will ask you for the following personal details: First name, email address, mobile phone number (not compulsory) and date of birth (not compulsory). This information is then used to:
i) email you newsletters and special offers (if you choose to receive them).
ii) text you marketing messages (messages sent by IVA will be free unless a roaming charge is made by your network operator.)
If you have booked with us you will automatically be sent one newsletter from us. At this time you can choose to continue to receive them or remove your registration in one click.
If you have entered an IVA competition you would have agreed to subscribe to our email newsletters. You can unsubscribe using the link in the email at any time.
You are legally entitled to know what personal information an organisation holds about you and how that information is processed. If you would like to know what information we currently hold about you, please contact us.
YOUR TOUR CONTRACT
The contract is between the Company and you (“i Visit Albania” and “you” in these conditions), being any person travelling or intending to travel on a tour operated by us including any person who is added or substituted after booking. We both agree that English law (and no other) will apply to your contract and to any dispute, claim or other matter of any description which arises between us (except as set out below). We both also agree that any dispute, claim or other matter of any description (and whether or not involving any personal injury) which arises between us must be dealt with by the Courts of Albania only. No employee of the Company other than a director has authority to vary or omit any of these terms. No promise of a discount or refund will be binding on us unless confirmed by us in writing.
TO SECURE YOUR BOOKING
The deposit will be confirmed at the time of booking. See also “How to Book” section. All clients (including anyone who is added or substituted at a later date), whether booking in person, by telephone, via our website, by e-mail or facsimile or by any other means, will be deemed to have agreed to the following four conditions: To secure a booking, we or our authorised travel agent must receive payment of the minimum deposit of 10% of the total tour price, per person, (or full payment if booking within 60 days of the start of your tour or at an earlier stage for some tours). A higher deposit will be payable if any supplier(s) requires additional payment at the time of booking / prior to balance due date. On occasions, full payment for a service such as your flights may be required at the time of booking. The applicable
 
a) they have read and accepted our Booking Conditions and general information pages contained in our brochure and/or on our website.
b) they appreciate and accept the risks involved in adventure travel.
c) they do not suffer from any pre-existing medical condition or disability which may prevent them from actively participating in the tour. If any person suffers from any medical condition or disability which will or may affect their tour arrangements, please contact us before making your booking to discuss your requirements.
d) the person making the booking confirms that he/she is at least 18 years old and has full authority to enter into a contract on the basis of these conditions on behalf of all persons named on the booking and confirms that all such persons are fully aware of and accept these conditions.
 
With the exception of self-guided tours (see below), a booking is accepted and becomes definite only from the date when we issue a confirmation invoice to you or your authorised travel agent. It is at this point that a contract between us comes into existence.
If you book online, any acknowledgement of your booking request we send to you in the meantime is not a confirmation of your booking. Before your booking is confirmed and a contract comes into force, we reserve the right to increase or decrease holiday prices. Where our allocation of air seats has been fully utilised or where it is not possible to offer an air seat from an allocation, we reserve the right to pass on any extra costs incurred. We reserve the right to decline any booking at our discretion.
We will communicate with you by e-mail. You must therefore check your e-mails on a regular basis. We may also contact you by telephone and/or post if we cannot, for whatever reason, contact you by e-mail. Certain documents may need to be sent by post. References in these conditions to “send” and “in writing” or similar include communication by e-mail. You should contact us by e-mail if you need to do so for any of the reasons mentioned in these booking conditions (for example, to request an amendment).
We may not be in a position to confirm the costs for all services forming part of your self-guided holiday at the time of booking until your services are confirmed. Where any costs cannot be confirmed, we will provide you with an estimated price for your holiday which will be based on anticipated rates and costs. If you wish to proceed with the booking and we are in a position to do so, we collect the necessary deposit on the basis that the price you have agreed to pay will be the one applicable to your holiday after confirmation of all costs. Once we have confirmation of all applicable costs, we will issue a confirmation which will show the confirmed price. This price may be higher or lower than the estimated price. It is at this point that our price guarantee will take effect. Any such difference will not be a surcharge and, if an increase, will be payable in full. If, however, any increase between the estimated price and the confirmed price shown on your revised invoice is greater than 10% of the estimated price, you may cancel your holiday and receive a full refund of all monies you have paid us other than any insurance premiums and amendment fees / charges providing you notify us in writing of your wish to do so within 7 days. No compensation will be payable in this situation.

I Visit Albania has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that I Visit Albania shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
OUR WEBSITE CHANGES REGULARLY
The main purpose of our Website is to provide information and booking facilities for travel destinations and associated products and services from time to time. We may update our Website from time to time, and may change the content at any time. Any of the material on our Website may be out of date at any given time, and we are under no obligation to update that material. We do not guarantee that our Website will be available 24/7, or that any content on it will be free from errors or omissions. We reserve the right to withdraw or amend our Website or parts of it without notice
YOUR REVIEWS AND CONTRIBUTIONS TO OUR COMMUNITY
You are invited to submit reviews and contributions to our online Community. If you contribute content to our Community, you agree to grant us a non-exclusive, royalty-free license to publish and use all your material in any way at any time on our Website and for marketing purposes.
